Heard Mr. Dubey, learned Advocate for Applicant and Mr. Karmakar, learned APP for State.

Perused the record of the case. Prima facie pursuant to the previous order a clear dichotomy is noticed with respect to the number of witnesses that were required to be examined by the prosecution. I have expressed my complete displeasure to the prosecution about it. However, Mr. Karmakar, learned APP has called the concerned Officer who is present in the Court today and on taking instructions he would persuade the Court not to make any observations and permit the prosecution to complete the trial within a period of one month from today.

Though as counter argument Mr. Pandey has also attempted to plead and persuade this Court to observe this conduct prima facie with respect to the delay that has occurred post passing of the order by this Court (Coram: Manish Pitale, J.), I would like to give the benefit of doubt to the prosecution considering the extent and work which the prosecution is required to do in the present case. Without going into and examining the merits of the matter, the prosecution is granted time by the Court. It is expected that the prosecution shall complete the trial as noted above. 4.

Needless to state that present Application shall be heard and finally decided on the next adjourned date which shall be noted by the prosecution.
