By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.584 of 2023, registered with Barshi City Police Station, Solapur, for the offences punishable under Sections 489 (A) (B) (C) and (D) r/w 34 of the Indian Penal Code.
3.
Having gone through the charge-sheet and the relevant material collected by the IO during the investigation, it is evident that the police have seized printing machine as well as partially printed fake currency notes, from the house of the applicant.
4.
The learned counsel for the applicant submits that tax invoice varsha
(29)-BA-1422-2024.doc shows that the said machine which was recovered from the applicant was purchased on the same day and thereafter there is every reason to believe that it was not used.
5.
Considering the recover of fake currency notes from the house of the applicant, at this stage, it is difficulty to say that the said machine was not used.
6.
The learned counsel for the applicant points out the other accused persons have been released on bail. But considering the recovery at the instance of the applicant and further the fact that there is antecedent of the similar nature against the applicant, I am of the opinion that it is no the fit case for grant of bail. Accordingly, it is rejected.
7.
Trial is expedited.
8.
Liberty is granted to the applicant to apply for grant of bail if there is no progress in trial, after nine months. 9.
The learned counsel for the applicant undertakes to place the copy of this order on the record of the trial Court within two weeks from today.
