This is an application for regular bail.

The applicant came to be arrested in Crime No.119 of 2022 registered at Laxmipuri Police Station, District :Kolhapur for the offences punishable under Sections 406, 408, 409, 420, 465, 468, 471(A) read with Section 34 of the Indian Penal Code (IPC) and under Section 3 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (MPID).

The applicant was working as a manager in Sonya Zeenat Pathan
1-BA-1445-2024.doc Maruti Nagari Sahakari Patsanstha, Kolhapur. The allegations against the present applicant and other co-accused are of defrauding the said Patsanstha to the tune of Rs.1,31,67,154.67/-.

The applicant is in jail for about two and half years and trial has not commenced. There are no other criminal antecedents against the present applicant. Considering the overall facts and circumstances of the case, I am inclined to release the applicant on bail.
ORDER
(i) Criminal Bail Application is allowed;
(ii) The applicant is directed to be released on bail in connection with Crime No.119 of 2022 registered at Laxmipuri Police Station, District :Kolhapur for the offences punishable under Sections 406, 408, 409, 420, 465, 468, 471(A) read with Section 34 of the Indian Penal Code (IPC) and under Section 3 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (MPID) on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;
