Heard learned advocate for the Applicant and learned APP. 2.
It is true that his earlier Bail Application No.3789 of 2022 was rejected on 19th July 2023. Liberty was granted to move again after six months, if there is no progress before the Trial Court. The charge is framed, but yet witnesses are not examined. He has arrested in present 1/3
offence on 30th August 2021. The offence is registered under Sections 307 and 120(B) of the Indian Penal Code, 1860 (IPC) and under Sections 37(1) and 135 of Bombay Police Act, 1951. 3.
The F.I.R. is lodged by the injured-Amit Jaiswal. He is a member of Shivsena party and the incident took place when he and his associate were sitting outside the office, the present Applicant along with his associate assaulted him with the help of knife. Even the Applicant was injured, and he was hospitalised in Sion Hospital, Mumbai. In fact, the said injuries were caused when he was about to run away. After the main incident, he was assaulted by other persons and there is an offence registered of rioting & under Section 326 at Rabodi Police Station.

Considering the incarceration for more than three years, now the Applicant is entitled to be released on bail with certain conditions. Hence, the order:
ORDER
(a) The Bail Application is allowed;
(b) The Applicant-Anis Usman Gani Sayyed is released on bail in connection with C.R. No.186 of 2021, registered with Rabodi 2/3
Police Station under Sections 307 and 120(B) of the IPC and under Sections 37(1) and 135 of Bombay Police Act, 1951 on furnishing personal bond and surety bond of Rs.25,000 [Rupees Twenty Five Thousand].
(c) He is directed not to threaten the prosecution witnesses. (d) He is directed to give attendance to Rabodi Police Station after released on 1st Monday of the month of October, January, and June from 10:00 am to 12:00 noon for two years.

Bail Application is disposed of.
