In the matter of Shekhar Prasad Mahto @ Shekhar Kushwaha vs. The Registrar General, Jharkhand High Court & Anr.
(Writ Petition (Criminal) No. 55 of 2025), the Hon'ble Supreme Court has clearly observed that when bail applications emanating from the same First Information Report (FIR) are assigned to different Single Judges or Benches within a High Court, it is both desirable and necessary that such applications be consolidated and placed before one learned Judge. This directive is intended to ensure that consistency and uniformity are maintained in the judicial process, thereby precluding the possibility of contradictory outcomes. It is further noted that in circumstances where a change in the roster results in the learned Judge, who was previously handling bail matters, no longer being assigned such cases, the aforementioned directive would not extend its application. 2.
In view of the cogent observations of the Hon'ble Supreme Court in Shekhar Prasad Mahto @ Shekhar Kushwaha (supra), it is accordingly directed that the present bail application be placed before the regular Bench currently designated for handling such matters, as per the prevailing roster.
