2. By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.182 of 2021, registered with Talegaon MIDC Police Station, Pune, District: Pune for the offences punishable under Sections 302, 323, 504, 506 read with Section 34 of the Indian Penal Code.

3. The learned counsel for the applicant submits that there are no allegations that the applicant inflicted any blow by knife on the RRaut

925-BA1518-2024.doc person of the deceased or he is the author of any of the injuries caused to the deceased.

4. Having gone through the charge-sheet and the relevant material collected by the Investigating Officer, it is evident that the applicant and the co-accused Mohammed Israil caught hold the deceased and facilitated the main accused-Jalal to repeatedly inflict blows by knife on the person of the deceased. The F.I.R. further shows that the applicant and Mohd. Israil were continuously instigating the co-accused Jalal to kill the deceased.

5. In the circumstances, it can be said that there is sufficient material available on record to show the complicity of the applicant in the alleged offence. The offence is very serious.

6. Thus, considering the nature of the offence and the evidence available on record, I am not inclined to grant bail. Accordingly, the Criminal Bail Application is rejected.
