Heard the learned Counsel for the applicant and the learned Special PP for Respondent No.2.

I have perused the report of Lilavati Hospital dated 17th April, 2024. After referring to the Diabetic, Cardiac, Renal, Neurologic, Ophthalmological and Pulmonologist Evaluations by the concerned specialists, the Interventional Cardiologist, Lilavati Hospital and Research Centre, Mumbai, has stated that for the above-mentioned multiorgan involvement, the patient - applicant will need hospitalization with medical and surgical intervention for the same.

The opinion of the Medical Officer does not equip the Court to determine the prognosis of the disease, the nature of medical and surgical intervention required, the line of treatment and the likely time required for the same. The information on the aforesaid aspects is necessary to equip the Court to decide as to whether the applicant requires continued hospitalization and, if so, whether it is necessary to have the treatment at the private hospital and whether the applicant requires to be enlarged on interim bail on medical ground.

It may, therefore, be necessary to call a specific report from the Superintendent/Chief Medical Officer, Lilavati Hospital and Research Centre, Mumbai, giving particulars of the prognosis of the disease, the nature of the medical and surgical intervention required, the line of treatment and the likely time required for the said treatment.

Let such report be submitted to the Court by Friday. 6.
List on 29th April, 2024.

Till the next date the applicant is permitted to be treated as an indoor patient at Lilavati Hospital and Research Centre, Mumbai.
