Praecipe is circulated on the ground of urgency stating that the Applicant is seeking bail on account of providing care and support for her two minor children who are living alone. One of her child is in 10th Std. and the other child is younger. It is stated in the praecipe that because of SSC examination in February, 2025, the aforesaid Application is moved. Though, I do not agree with the reason stated in the praecipe that if the Applicant is not released on bail the entire career of the child will be spoiled. Be that as it may. Considering the fact that two minor children are without their mother, I am inclined to list the matter after two weeks for the reason that the Investigating Officer shall file a report after investigation as to with whom the two Anand
926. BA 1563-2024.doc minor children are living at present. Initially, learned Advocate for the Applicant would submit that the two minor children are living alone without their mother. Later on, learned Advocate for the Applicant would submit that the two minor children are living with their aunt. Hence, the Investigating Officer shall ensure that a lady police officer is deputed to inquire and submit a report to this Court before the next adjourned date. Private Respondent No. 2 is the Original Complainant and mother of the victim. Since Protection of Children from Sexual Offences Act, 2012 (for short 'POCSO' Act) is also applied, Ms. Komal Sinha, learned Advocate practising at the bar is requested by the Court to appear and espouse the cause of the Applicant through the High Court Legal Services Committee, Mumbai. Her appointment Order shall be issued. Learned Advocate for the Applicant to provide a copy of the papers and a copy of this Order without fail in order to avoid delay. 2.
