This is an Application under Section 439 of the Criminal Procedure Code, 1973 seeking regular bail in connection with C.R.No.788 of 2023 registered with MIDC Police Station. 3.

Pursuant to the order dated 07.01.2025, Investigating Officer has filed a report after investigation. I have perused said report, it is dated 19.01.2025. Prima facie, said report is inadequate and I have directed the learned APP to direct the investigation to be conducted in

902.BA.1563.24.doc a precise manner in order to ascertain the details of the two children of the Applicant residing all alone in the said premises, as to who is paying the rent for the said premises to the landlord, who is providing care and looking after them and all such relevant details so that this Court can be in a position to pass appropriate orders in the Bail Application on the next adjourned date. Prima facie, it is seen that daughter of the Applicant is 17 years and son of the Applicant is 15 years old.

Prosecution shall furnish a proper report after due investigation on or before the next adjourned date. It shall be open to the Applicant to place on record the details of the SCC examination of her son so that the same can be also considered. 5.

Stand over to 5th February 2025.
