Having heard the learned counsel for the applicant and the learned APP for some time, in the peculiar facts and circumstances of the present case, it would be appropriate that the learned counsel for the applicant takes instructions as to whether any family member of the applicant from her mother's side, is ready to take care of her, if at all the present bail application is to be allowed. This is particularly in the background of the report dated 09.09.2024 issued by the Medical Officer, Kalyan District Prison Class-I, Kalyan, wherein it is recorded that although the applicant had history of psychiatric illness, in August 2023, she appeared to be alright to the staff and other inmates. But, after her husband i.e. the informant in the present case visited her, she became withdrawn, stopped talking and eating as a result of which she had to be force fed. She also tried to strangulate herself twice during the said period.

In such a situation, although the husband of the applicant i.e. the informant is present in the Court and he has expressed his desire to take care of the applicant if she is enlarged on bail, this Court is of the opinion that it would not be safe to accept the request made in that regard. 3.

Adjourned to 25.09.2024, to be included in the supplementary list, by which time the learned counsel for the applicant shall take appropriate instructions in the matter.
