2. By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.267 of 2023, registered with Ghodegaon Police Station, District: Pune Rural for the offences punishable under Sections 376D, 323, 504, 506 read with Section 34 of the Indian Penal Code, 1860.
3. Having gone through the charge-sheet and the relevant material collected by the Investigating Officer, during investigation, it is evident from the medical report and the other documents that RRaut
915BA1648-2024.doc there is sufficient incriminating material available on record to show the complicity of the applicant in the alleged offence. The offence is heinous one. The applicant and the other accused committed gang rape on the victim. During the medical examination injuries were found on the person of the victim.
4. Thus, considering the nature of the offence, which is heinous one, the submission made by the learned counsel for the applicant that since the charge-sheet has been filed his custody is not required, cannot be accepted.
In the circumstances, the Criminal Application is rejected.
5. Fees of the Advocate appointed to represent the respondent No.2 be quantified as per the Rules.
