Heard Mr. Mukte, learned Advocate for Applicant and Ms. Newton, learned APP for Respondent - State. 3.

Mr. Mukte, learned Advocate for Applicant informs the Court that incident took place on the spur of the moment due to a quarrel which ensued between the victim and his wife. Victim is the brother-in-law of the Applicant. Precursor to the incident happened to be at birthday celebration where Applicant had joined the victim (brother-in-law) and his sister for dinner and a party. After returning from the birthday party to their house a sudden quarrel ensued between the victim and his wife due to which the victim assaulted his wife (sister of Applicant) according to prosecution case. This enraged the Applicant on seeing his sister being assaulted, upon which

53_BA_1658_2024.docx Applicant with the help of kitchen knife gave a singular blow in a fit of rage resulting in fatal injury caused to him. 4.

Considering the aforesaid submissions made by the learned Advocate for Applicant, learned APP is directed to take appropriate instructions and also confirm the aforesaid submissions from the record and accordingly apprise the Court on the next adjourned date.

Considering the long incarceration of the Applicant since 20.04.2021 and in view of the above facts, Court will take up the present Application for hearing on the next adjourned date. 6.

Stand over to 8th April, 2025. To be listed on the Supplementary Board.
