The applicant herein had earlier moved Bail Application No.1694 of 2021, which was dismissed as withdrawn and this Court (Coram : Smt. Anuja Prabhudessai, J.), by the order dated 09.08.2023, directed that the trial shall be concluded within a period of one year from the date of receipt of the said order. On 02.09.2024, this Court passed an order in a letter received from the Court of Special Judge under MCOC and Additional Sessions Judge, City Civil and Sessions Court, Greater Mumbai, where the trial is pending, whereby extension of time by one year was sought for disposing of the trial.

By the said order dated 02.09.2024, this Court granted extension of time by one year and in paragraph 5 of the said order, this Court observed as follows:- "5.

Insofar as the applicant - Bharat Pradip Solanki is concerned, liberty is reserved for the said applicant to move a fresh application for bail in the light of the aforementioned changed circumstances brought to the notice of this Court." It appears that pendency of the present application was not brought to the notice of this Court.

This Court is informed that in the light of the liberty granted by this Court in the above-quoted paragraph, the applicant had moved a fresh bail application before the Sessions Court, which has been dismissed and that subsequently, Bail Application No.4808 of 2024 has been filed by the applicant before this Court. 5.

In that light, the present application i.e. Bail Application No.1678 of 2024 is disposed of with liberty to the applicant to pursue Bail Application No.4808 of 2024.
