Investigating Officer (IO) in the present matter has been transferred to Pune. He is present in Court. Considering the seriousness of the matter since the chargesheet has been filed, learned APP has informed the Court that appropriate directions be passed to the concerned Senior Police Inspector (Sr.P.I.) of the concerned Police Station to appoint appropriate IO to prepare the report as called for by the Court.

In the present case it is seen that merely on the statement of the victim who is 5 & 1/2 years old, the father of Munna & Bunty is apprehended as the culprit in the matter. The father of Munna & Bunty
909. BA-1681-2024.docx was present according to the victim in the shop on the date and time of the incident. The shop in question is a Kirana / Milk & Dairy shop operated by the Gurav family. Gurav family comprises of Applicant, his two sons, who are both Government Doctors, his brother's wife, her three sons and their four children which are depicted in the chart presented before the Court from the record. Reference to Munna and Bunty is not clear to the Court. Sr.P.I. of Malad Police Station is directed to appoint an IO to investigate the aforesaid facts and unearth who is Munna and Bunty referred to by the victim in his statement and their father. The IO who had investigated the matter earlier is now Sr. P.I. and transferred to Pune and is present before the Court today. Newly appointed IO shall take appropriate instructions from the concerned IO who had investigated the matter earlier, carry out appropriate investigation and prepare a report so that the same can be considered by the Court for the purpose of hearing of the present Application for Bail.

Let the report be filed within a period of one week from today. 5.
