This is an application under Section 439 of the Code of Criminal Procedure for grant of bail. The applicant came to be arrested in Crime No. 321 of 2022 registered at Islampur Police ARUN RAMCHANDRA SANKPAL Station for the offences punishable under Sections 489A, 489-B, ARUN RAMCHANDRA SANKPAL Date: 2024.08.06 18:18:24 +0530 489-C read with Section 34 of Indian Penal Code. 2.

On 07.05.2024, the bank officials of ICICI Bank, Islampur branch, while collecting the cash deposited by the customers in Cash Deposit Machine had found that there were six counterfeit currency notes of Rs.500/- denomination. The report was thus

lodged and during investigation the said counterfeit currency notes were found to be deposited by the present applicant. 3.

This Court by order dated 16.02.2023 in Criminal Bail Application No. 3450 of 2022 rejected the first bail application of the present applicant. The Hon'ble Supreme Court has also refused to release the applicant on bail and by order dated 28.04.2023 rejected the special leave petition. 4.

The learned counsel for the applicant submits that the applicant is in jail for more than two years. It is submitted that this Court by order dated 05.01.2024 in Bail Application No. 1516 of 2023 filed by the co-accused, directed the Trial Court to conclude the trial within a reasonable period of time. It is submitted that still the trial is at the stage of framing of charge only 5.

The learned counsel for the applicant submits that the request of the applicant for bail be considered due to long incarceration with the unlikelihood of the trial being completed in near future. In support of his contention, the learned counsel for the applicant has placed reliance on the judgment of the Hon'ble Supreme Court in Javed Gulam Nabi Shaikh Vs State of

Maharashtra and Another 2024 SCC OnLine SC 1693. 6.

Considering the overall facts and circumstances of the case, and in absence of any change in circumstances to entertain the present application, it would be appropriate to expedite the trial. The Trial Court shall make an endeavour to complete the trial within a period of six months. Liberty is granted to the applicant to file application for bail after the period of six months, if the trial is not concluded by that time.
