After hearing for sometime, it is informed that the report of DNA is awaited. Considering the material collected by the IO during the investigation and from the charge-sheet it establishes prima facie involvement of the applicant. Thus, on expressing non-intimation to grant bail, the learned counsel for the applicant seeks permission to withdraw the present application with liberty to file a fresh application on receipt of the DNA report.

Accordingly, permission to withdraw the bail application is granted with liberty to move a fresh application after receiving the DNA report.
