In this application, the learned counsel for the applicant submits that a co-accused person was granted bail by order dated 18th April 2024 passed by this Court (Coram: M. S. Karnik, J.) in Bail Application No.4177 of 2023, on the basis of an affidavit / undertaking given by the co-accused person i.e. the father of the applicant to return amount to the bank in equal monthly installments.

In this application, the wife of the applicant / accused has sworn an affidavit / undertaking on similar lines in order to repay the amount to the bank in equal monthly installments. The said affidavit / undertaking along with documents is taken on record. 3.

It would be appropriate that complainant / bank is before this Court so that the application can be disposed of. The complainant / bank may intervene, if it so desires, before the next date. 4.

List on 23rd July 2024. To be included in the supplementary list."

It appears that the complainant bank is also not before this Court despite the observations made in the above-quoted order. In such a situation, there is no alternative but to adjourn this application for further consideration. Hence, list on 27.08.2024.
