Learned counsel Shri Upadhyay, appearing for the intervenor, submits that in this changed circumstance, the Applicant should approach the Court of Magistrate for his release on bail and this Court may not directly entertain the present Application in the changed circumstance. Learned counsel appearing for the Applicant seeks liberty to withdraw this Application and to approach the Court of Magistrate for his release on bail in the changed circumstance. The permission is granted. The Application is allowed to be withdrawn with liberty to approach the Court of Magistrate for his release on bail.
