Heard Mr. Shaikh, learned Advocate for Applicant and Ms. Bajoria, learned APP for Respondent - State.

In the present crime, Applicant is incarcerated for more than 4 and 1⁄2 years when during the first lockdown in COVID-19 pandemic period, Applicant was arrested in the alleged incident. Mr. Shaikh would submit that though charge has been framed in January 2024 the trial has not commenced and therefore he would persuade the Court to consider long incarceration of Applicant pending trial for releasing him on bail.

He would fairly inform the Court that Applicant is having several antecedents but in some of them he has been acquitted. He would also fairly inform the Court that according to prosecution case Applicant has used a firearm and has also inflicted stick blows on the

Ms. Bajoria, learned APP appearing for the prosecution shall ascertain the veracity of the submissions made on behalf of the Applicant from the record of the case and accordingly apprise the role of Applicant in the crime to the Court on the next adjourned date. Considering his incarceration in prison, prosecution shall also ascertain the status of the trial and inform the same to the Court for consideration.

List the Bail Application on Board for hearing and disposal on 09th June, 2025.
