This application is listed today at Serial No.50 in the cause list. It was mentioned in the morning on the ground that the hearing may not reach considering the heavy board of this Court. It was specifically submitted that there is a medical emergency insofar as the applicant is concerned, as he is suffering from chest pain and that he is allegedly not being given treatment by jail authorities. On this basis, this Court directed that the application shall be called, out of turn at 4:30 p.m. Eventually, it was called out at 5:32 p.m.

The learned APP has specific instructions in the matter and he has tendered Prisoner's Medical Report of today, wherein the Chief Medical Officer of Taloja Central Prisoner has stated that the present health status of the applicant is as follows :
bipin prithiani 50-ba-1870.24.doc "Prisoner was having chest pain on and off since 2 months for that his ECG test has been carried out at prison hospital which was found to be within normal limit. Recently he was examined at prison hospital on dated 09.07.2024 where his blood pressure was raised to 160/100 mm/hg for that he was given Tab. Telma 40 mg daily. His all other parameters at the same time was within normal limit. He was not having any cardiac related symptoms. Hence he was advised to continue his medications."

The said Prisoner's Medical Report dated 15th July 2024 is taken on record and marked 'x'.

Obviously no case is made out for hearing the present application out of turn.

The application shall be heard in its own turn on 12th August 2024 (High on Board).
