Heard Mr. Kulkarni, learned Advocate for Applicant and Ms. Newton, learned APP for Respondent - State.

Mr. Kulkarni would submit that Applicant is incarcerated in an offence of cheating alongwith other allied Sections of the Indian Penal Code, 1860 (for short "IPC") and Information Technology Act, 2000 for the past 14 months. He would submit that 4 out of 7 accused are enlarged on bail and he would claim parity with Accused No.1 who has been enlarged on bail. He would submit that role of the Applicant is identical to that of Accused No.1 and therefore present Application be considered for grant of bail.

Next he would argue that apart from the punishment provided for offences under Sections 466 and 468 of IPC all other offences against the Applicant would entail a punishment of 3 years only and in that view of the matter, long incarceration of Applicant for 14 months be considered by the Court for grant of bail. 4.

Ms. Newton, learned APP shall take appropriate instructions from the concerned Investigating Officer and apprise the specific role of the Applicant on the next adjourned date, after which Application of the Applicant shall be considered.
