Sudhir Bharat Kamble v. The State Of Maharashtra
903-BA-1934-24.DOC Sayali Upasani
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION CRIMINAL BAIL APPLICATION NO. 1934 OF 2024 Sudhir Bharat Kamble ...Applicant Vs.
The State of Maharashtra
...Respondent
Mr. Prashant S. Hagare, for the applicant.
Mr. S. M. Mangaonkar, APP for State-Respondent. CORAM:- ANIL S. KILOR, J.
DATED:- 8th AUGUST, 2024 PC :- 1) Heard.
2) By this application under Section 439 of the Code of Criminal Procedure, the applicant is seeking bail in Crime No. 13 of 2024 registered with Walchandnagar Police Station, Dist.Pune, for the offences punishable under Sections 326-A, 342, 376(2)(n), 504 and 506 of the Indian Penal Code, 1860.
3) Having considered the charge-sheet and the relevant material collected by the Investigating Officer during the investigation, it is evident that the offence is serious and the allegations made in the 1/2
903-BA-1934-24.DOC complaint not only show that the applicant repeatedly threatened the victim to establish the physical relations with her but also attacked by throwing acid on the victim.
4) Thus, considering the nature of allegations and material collected by the Investigating Officer, there is every possibility that if the applicant is released on bail, there is threat to the life of the victim and furthermore he may pressurise the witnesses of the prosecution and in that event there would be no fair trial.
5) In the circumstances, I am of the opinion that this is not a fit case to grant bail. Accordingly, the application is rejected. [ANIL S. KILOR, J.] 2/2
