By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.142 of 2022 registered with Sawantwadi Police Station, District Sindhudurg, for the offences punishable under Sections 307, 324, 504, 506 of the Indian Penal Code.

Having gone through the charge sheet and relevant material collected by the Investigating Officer during investigation it is evident that there are four antecedents of the Applicant of similar nature. There are eye witnesses and sufficient incriminating evidence available and therefore there is every possibility that if Applicant is released on bail he may commit similar offence. Thus, there is every likelihood that the trial would be concluded in near future.

Accordingly I pass following order :

ORDER

(i) Application is rejected;

(ii) Considering the period of incarceration of Applicant, the Trial Court is directed to expedite the trial and make an endeavour to conclude the same within a period of nine months from the date of receipt of copy of this order;

(iii) Liberty is granted to the Applicant to apply afresh before Trial Court for bail after nine months, if there is no progress in trial; (iv) Learned advocate for Applicant undertakes to produce copy of this order on the record of Trial Court within two weeks from today. (ANIL S.KILOR, J.) MST
