Heard the learned Counsel for the applicant and the learned APP for the State.

When the Court expressed its disinclination to entertain the prayer for bail, the learned Counsel for the applicant seeks leave to withdraw the application. 3.
The learned Counsel for the applicant, however, submits that despite the order dated 21st February, 2024 passed in BA/3858/2023 requesting the trial court to conclude the trial in Special Case No.942 of 2021 as expeditiously as possible, there has not been much progress in the trial. Only one witness has been examined in the 1/2
14-BA1950-2024.DOC month of June, 2024. Therefore, a time frame may be stipulated.

The applicant is stated to be in custody since 12th February, 2021. This Court has requested the trial court to conclude the trial as expeditiously as possible. Having regard to the period of incarceration of the applicant and the submissions made on behalf of the applicant, it may be expedient to request the trial court to conclude the trial as expeditiously as possible and, preferably, within a period of nine months from the date of the communication of this order.

In the event the trial is not concluded within the said period, the applicant is at liberty to revive the prayer for bail. 6.
Application disposed.
