Heard Ms. Qureshi, learned Advocate for Applicant appointed through legal aid and Mr. Haldankar, learned APP for Respondent.

The order dated 04.04.2025 stands complied with. Copy of Application is handed over to Ms. Qureshi.

Considering order dated 04.04.2025, Mr. Haldankar, learned APP has persuaded the Court to grant him one more week to place the Affidavit on record considering that Applicant is indicted in a crime under the Special Act. However what impels the Court to consider case of Applicant for bail is his long incarceration pending trial for a period of 6 years 9 months 7 days wherein trial has commenced but it has not progressed as required despite being expedited by this Court.

One of the submission made by Ms. Qureshi is that trial has been expedited and made time bound by this Court by order passed some time in July - 2024 despite which trial is pending. 5.

Mr. Haldankar, learned APP shall take appropriate instructions and place the same on Affidavit-in-Reply. It is clarified that if Affidavit is not filed within a period of one week, this Court will not await or grant any further time to the prosecution and decide the present case on the ground of long incarceration pending trial of the Applicant. Copy of Affidavit be served upon Ms. Qureshi in advance. 6.

Ms. Qureshi would submit that out of the total six accused persons one Accused has already been enlarged on bail. 7.

Stand over to 22nd April, 2025. To be placed under the caption 'First on Board'.
