Heard Mr. Dave, learned Advocate for Applicant; Mr. Arjun, learned Advocate for Respondent No.2 and Mr. Kulkarni, learned APP for Respondent - the State of Maharashtra.

This is an Application under Section 439 of Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') seeking Bail in connection with C.R. No.992 of 2023 registered with Sakinaka Police Station for offences punishable under Sections 376, 367(AB) and 506 of Indian Penal Code, 1860 read with Sections 4, 8 and 12 of Protection of Children from Sexual Offences Act, 2012 (for short 'POCSO'). 3.

Applicant is incarcerated since 15.10.2023. Today when the matter has reached for hearing the Advocate appointed by the Court is

6.BA.1963.2024.doc absent. Some other Advocate on his behalf says that he is in difficulty. This practice will not be tolerated by the Court. Everyday for the person who is incarcerated counts.

The Advocate appointed is directed to remain present tomorrow failing which another Advocate shall be appointed by this Court to represent and espouse the cause of Respondent No.2 5.
