DATED : 2nd AUGUST, 2024 P.C:- My attention is invited to the order dated 14/3/2024 passed in Criminal Writ Petition (St) No. 541/2024 by this Court. It is surprising to note that when this Court directed the Special Judge to conclude the trial within one year and when the witnesses were summoned, the Addl. Sessions Judge forfeited the right of the prosecution to lead further evidence and straight way jumped to the stage of recording of the statement of the accused under Section 313 of Cr.P.C, and this order has been stayed by this Court on 14/3/2024.

The only solution which is in foresight is that the prosecution move the Court dealing with the Writ petition and Tilak

2/2 5 BA 1982-24.doc get an appropriate clarification by pointing out that the trial must ultimately come to an end and by giving a specific time schedule, and on assurance that the trial shall be concluded within the shortest possible time.
