Heard Mr. Sawalkar, learned Advocate for Applicant; Ms. Bajoria, learned APP for Respondent No.1 and Mr. Mishra, learned Advocate for Respondent No.2 appointed through legal aid at length and perused the record of the case.

I expressed my disinclination to Mr. Sawalkar to consider the Bail Application after the hearing concluded. Mr. Sawalkar requested the Court not to pass any order on merits and to consider that Applicant is a woman and is required to provide care and support to two minor children and hence he would persuade me to pass appropriate directions for expeditious completion of trial. The said request made by Mr. Sawalkar undoubtedly can be considered by the Court.

In that view of the matter, learned Trial Court is directed to expedite hearing and completion of the trial as expeditiously as possible strictly in accordance with law.

Though Mr. Sawalkar would pray to the Court that liberty be granted to Applicant to approach the Court once again for bail, such liberty is not required by the Applicant. Every day of incarceration in jail would entitle Applicant to file Bail Application as a matter of right in accordance with law as a changed circumstance and no such liberty is therefore required to be specifically granted by the Court. 5.

Fees of the learned Advocate Mr. Mishra appointed through legal aid to represent and espouse the cause of Respondent No.2 shall be released by the Registry of this Court within a period of one week from the date of presentation of a server copy of this order on compliance.

Bail Application is disposed.
