2) By this application under Section 439 of the Code of Criminal Procedure the applicants are seeking bail in Crime No. 376 of 2022 registered with Sinhagad Road Police Station, Pune for the offence punishable under Section 302 of the Indian Penal Code, 1860. 3) In the present matter, there is sufficient incriminating material available on record against the applicant by way of CCTV footage, which has captured the actual incident, wherein it was seen that the applicant was throttling the deceased.

Accordingly, the application is rejected and disposed of. 5) Liberty is granted to apply before the trial Court after one year if there is no progress in the trial.
