By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.662 of 2023, registered with Sangola Police Station, Solapur, for the offences punishable under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, 'NDPS' Act), Section 34 of the Indian Penal Code (for short, 'IPC')and Section 65(e) of the Maharashtra Prohibition Act.

The quantity of contraband found in possession of the applicant was intermediate quantity i.e. 1.9 kg. ganja and illicit liquour.

There are no antecedents under NDPS Act.

The applicant is in jail from last 1 year and in the meantime the investigation was completed and the charge-sheet has been filed.

In the circumstances, considering the above referred facts, I am of the opinion that though the learned APP is strongly opposing the application, further custody of the applicant is not necessary. Accordingly, I pass the following order:
ORDER
(i) Criminal Bail Application is allowed and disposed off; (ii) It is directed that the applicant shall be released on bail in Crime No.662 of 2023, registered with Sangola Police Station, Solapur, for the offences punishable under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985, Section 34 of the Indian Penal Code and Section 65(e) of the Maharashtra Prohibition Act, on furnishing P.R.Bond of Rupees Fifty Thousand with one solvent surety in the like amount;
iii) The applicant shall attend Police Station, District Pune, on 1st day of every month, till conclusion of trial; iv) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also not tamper with the
evidence;
v) Liberty is granted to the State for cancellation of bail if the applicant commits similar offence;
vi) The applicant shall attend the trial before the Trial Court regularly on every date unless exempted by the trial Court for any reason.
