2) By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.360 of 2022 registered with Ratnagiri City Police Station, for the offences punishable under Sections 302, 397, 201 and 120-B of the Indian Penal Code, 1860. 3) Having gone through the charge-sheet and the material collected by the Investigating Officer during the investigation, it is evident that there is sufficient incriminating material available on record by way of CCTV footage from which it is evident that the deceased entered into the shop of the accused No. 1 and thereafter the applicant and the other coaccused enter into the shop. 3-BA-2122-24.DOC deceased never came out of the said shop but in the night, all three accused carried something in a gunny bag and loaded the same in the auto-rickshaw, which was thereafter taken by the applicant and the other co-accused. The charge-sheet further shows that the dead body was recovered at the instance of the applicant. 4) Considering the seriousness of the offence and the nature of the evidence collected by the Investigating Officer during the investigation against the applicant, I am of the opinion that this is not a fit case for grant of bail.
