By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.522 of 2023, registered with Paud Police Station, Pune Gramin for the offences punishable under Sections 307, 364(A), 294, 324, 504, 506, 34 and 212 of the Indian Penal Code.

Having gone through the charge-sheet and the material collected by the IO during the investigation, more particularly, the injury certificate coupled with the period of incarceration of the applicant and also the fact that the charge-sheet has been filed, I am of the opinion that this is a fit case for grant of bail.

In the complaint the applicant referred as unknown person. Furthermore, general allegations are made against the applicant. There are no antecedents against the applicant.

The learned APP is strongly opposing the application and has expressed the apprehension that if the applicant is released on bail he may commit the similar offence. As far as apprehension of the learned APP is considered, the same can be addressed by imposing certain stringent conditions.

At this stage, the learned counsel for the applicant, on instructions, submits that the applicant is ready to abide by any conditions, including the condition not to enter into territorial jurisdiction of Pune District.

In the circumstances, I pass the following order:
ORDER
(i) Criminal Bail Application is allowed and disposed off; (ii) It is directed that the applicant shall be released on bail in Crime No.522 of 2023, registered with Paud Police Station, Pune Gramin for the offences punishable under Sections 307, 364(A), 294, 324, 504, 506, 34 and 212 of the Indian Penal Code, on furnishing P.R.Bond of Rupees Twentyfive Thousand with one solvent surety in the like amount; iii) The applicant shall attend the said Police Station on 1st day of every month between 10.00a.m to 11.00 a.m., till
the conclusion of the trial except on the date of trial and also the trial in the matters if any pending against the applicant; iv) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also not tamper with the evidence;
v) Liberty is granted to the State for cancellation of bail if the applicant commits similar offence;
vi) The applicant shall attend the trial before the Trial Court regularly on every date unless exempted by the trial Court for any reason.
