2. By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.342 of 2022, registered with M.I.D.C. Police Station, District: Solapur for the offences punishable under Sections 307, 201, 323, 143, 147, 148, 149 of the Indian Penal Code, 1860, Sections 4 and 25 of the Indian Arms Act, 1959 and Sections 37(1) and 135 of the Maharashtra Police Act, 1951.

3. Having gone through the charge-sheet and the relevant material collected by the Investigating Officer during investigation, it is RRaut Corrected as per order dated 09/10/2024 1 of 2

931-BA2129-2024-Corrected.doc evident that the offence is very serious considering the injuries caused to the injured and further considering the common intention of the accused and formation of unlawful assembly for the said purpose. There are eyewitnesses, who not only named the applicant, but they have also attributed the role to the applicant. The applicant was carrying sword in their hands and inflicted blows by the same on the victim.

4. In the circumstances, since the offence is serious and considering the maximum punishment, I am not inclined to grant bail to the applicant. Hence, the Criminal Bail Application is rejected.

5. Considering the period of incarceration of the applicant, the trial is expedited and liberty is granted to the applicant to apply afresh before the trial Court after six months, if there is no progress in the trial.
