At the outset, learned APP for State would inform the Court that instructions will have to be called from Respondent No.2 as to whether she requires legal representation or otherwise. 4.

In that view of the matter, learned advocate for Applicant is directed to serve a fresh copy of the Application on the Investigating Officer.

Investigating Officer is directed to take appropriate instructions from Respondent No.2 as to whether she requires legal representation and apprise the Court about the same through learned APP on next adjourned date.

Mr. Arora, learned Advocate for Applicant would inform the Court that this is second bail Application filed by Applicant. While rejecting previous Bail Application this Court has granted liberty to the Applicant to prefer a fresh application pursuant to recording of statement of victim. He would inform the Court that said statement has been recorded and in that view of the matter he would persuade the Court to consider present Bail Application. On the other ground he would submit that Applicant is incarcerated for more than past 32 months. He would inform the Court that at the time of incident age of prosecutrix was 12 1⁄2 years and the age of Applicant was 27 years. 7.
