When this application is called out for hearing, there is no appearance on behalf of the applicant. The learned APP and the learned counsel appointed to appear on behalf of respondent No.2 are present in Court.

The learned APP, on instructions, makes a statement that in the present case trial is almost over, for the reason that the statement of the accused under Section 313 of the Cr.P.C. is already recorded and as per the roznama of the concerned Trial Court, the case is now listed for final arguments on 06th December, 2024. Apart from this, it is brought to the notice of this Court that earlier bail application bearing Criminal Bail Application No.3365 of 2022, moved on behalf of the very same applicant Shrikant Malani
7.BA.2144.2024.doc was dismissed by this Court (Coram : Prithviraj K. Chavan, J.) by order dated 12th March, 2024, as there was no appearance on behalf of the applicant and it had to be dismissed for want of prosecution.

Considering the stage of the proceedings before the Trial Court, which indicates that trial itself would be over in the near future, as also on the ground of non appearance on behalf of the applicant, the present application is dismissed.
