By this application under Section 439 of the Code of Criminal Procedure the applicants are seeking bail in Crime No.17 of 2014, registered with Kurduwadi Police Station, Solapur, for the offences punishable under Sections 341, 395, 396 and 397 of the Indian Penal Code.

Having gone through the charge-sheet and the material collected by the IO during the investigation, it is evident that the FIR was

registered against the unknown persons and the applicants were implicated in the present offence on the statement of the co-accused. It is further evident that no test identification parade was conducted. 4.

In the circumstances, considering the nature of material collected against the applicants, during the investigation, there is a reasonable ground to believe that the applicants are not involved in the alleged offence.

In the circumstances, I am of the opinion that the applicants are entitled for grant of bail. Accordingly, I pass the following order:

ORDER

(i) Criminal Bail Application is allowed and disposed off; (ii) It is directed that the applicants shall be released on bail iin Crime No.17 of 2014, registered with Kurduwadi Police Station, Solapur, for the offences punishable under Sections 341, 395, 396 and 397 of the Indian Penal Code, on furnishing P.R.Bond of Rupees Fifty Thousand (each) with one solvent surety in the like amount;

iii) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also not tamper with the evidence;

iv) Liberty is granted to the State for cancellation of bail if the applicants commits similar offence;

v) The applicants shall attend the trial before the Trial Court regularly on every date unless exempted by the trial Court for any reason.
