Heard Ms. Patil, learned Advocate for Applicant and Mr. Dedhia, learned APP for State.

Applicant's case is that he was working as a driver in the Company of principal accused in the present crime who has been indicted for offences punishable under IPC and MPID Act. According to Ms. Patil, complaint of the investors qua the Applicant is that during his tenure of 5 months from November 2022 to February 2023, they have invested certain amounts through the Applicant in the said Company for seeking high returns. She would inform the Court that the amounts deposited by the investors through the Applicant were returned by the Applicant to the Company which is borne out by the

48. BA-2176-24.docx bank statements. As directed on the previous date, she has prepared a detailed chart of the amounts which have been returned back by the Applicant. Copy of the same is given to the prosecution also. Prosecution shall take cognizance of the same while filing their reply affidavits.

Considering the indictment of the Applicant under IPC and Special Act and he being incarcerated for more than 16 months, Respondents are directed to file their reply affidavits positively within a period of two weeks from today.
