2) By this application under Section 439 of the Code of Criminal Procedure the applicants are seeking bail in Crime No. 451 of 2023 registered with Nashik Road Police Station, Nashik for the offence punishable under Sections 376(2)(n), 376(a)(b) of the Indian Penal Code, 1860 and Sections 4 and 8 of the Protection of Children from Sexual Offices Act, 2012.

3) Having gone through the charge-sheet and the relevant material collected by the Investigating Officer during the investigation, it is evident that there is sufficient incriminating martial available on record to show his involvement in the alleged offence. The incriminating material is in by way of medical evidence further the statement of the victim, who is a minor. It is also pointed out by the learned APP that the 1/2

913-BA-2195-24.DOC obscene photographs of the victim were found in the mobile of the applicant.

4) Thus, considering the material available on record, I am of the opinion that since prima facie involvement of the applicant is established, this is not a fit case for grant bail as the offence is very serious. Accordingly, the application is rejected and disposed of. [ANIL S. KILOR, J.] 2/2
