By this application under Section 439 of the Code of Criminal Procedure the applicants are seeking bail in Crime No.1216 of 2023, registered with Kondhwa Police Station, Pune for the offences punishable under Sections 354 and 506 of the Indian Penal Code and Section 8, 10, 12 of the Protection Of Children from Sexual Offences Act (POCSO Act).

While rejecting the bail application, the trial Court has categorically observed that the trial can be concluded within couple of varsha

924-BA-2232-2024.doc weeks. This order was passed by 30.03.2024. However, it is informed that till date the charge is not framed.

In the circumstances, considering the nature of allegations and the material collected by the IO during the investigation and also the statement of the victim recorded by the Magistrate under section 164 of Cr.P.C., I am of the opinion that this is not a fit case for grant of bail. However, as observed by the learned Sessions Court it is directed that the trial be expedited and endevour be made to conclude the trial within 6 months.

Liberty is granted to the applicant to apply afresh for grant of bail after six months if there is no progress in trial. 6.

The application is disposed of.

Fees of the advocate appointed to represent the respondent no. 2 be quantified as per the rules.

The learned counsel for the applicant undertakes to place the copy of this order on the record of the trial Court, within two weeks from today.
