This is an application for bail.

The applicant came to be arrested in Crime No. 0797 of 2023 registered at Chikhali Police Station, Pimpri - Chinchwad for the offences punishable under Sections 363, 376 and 506 of the Indian Penal Code and Sections 3 and 4 of the Protection of Children from Sexual Offences Act (POCSO Act). 3.

I have heard the learned counsel for the applicant and learned APP for the State and learned counsel for respondent No.2. Pramod Lakare

I have perused the chage-sheet. Prima-facie the alleged act of sexual intercourse between the applicant and victim appears to be consensual. The applicant is 19 years old and is in jail for more than one year. The trial has not yet commenced. Considering the overall facts and circumstances, I am inclined to released the applicant on bail. In the result, the following order is passed.

O R D E R

A] The Application is allowed.

B] The applicant be released on bail in C.R.

No.0797 of 2023 registered at Chikhali Police Station, Pimpri - Chinchwad for the offences punishable under Sections 363, 376 and 506 of the Indian Penal Code and Sections 3 and 4 of the POCSO Act on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
