Heard learned counsel for the applicant. On the last occasion, it was submitted on behalf of the applicant that considering the health condition of the applicant, this Court may consider granting him interim bail. In that light, this Court had called upon the learned APP to take instructions in the matter.

Today, the learned APP has tendered Prisoner's Medical Report dated 04.07.2024 forwarded by the Superintendent of Thane Central Prison. The said report indicates that although the applicant does have a history of tuberculosis and diabetes, as also the fact that he is HIV positive, he is being given continuous treatment and medicines from the prison hospital. No case is made out for granting interim bail on medical ground. Instead, this Court is inclined to hear the present application on merits. 1/2
