2) By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.48 of 2020 registered with Satpur Police Station, Nashik, for an offence punishable under Sections 302 and 201 of the Indian Penal Code, 1860. 3) Considering that the sufficient incriminating material is available on record against the applicant and the fact that the trial has commenced coupled with the fact that till date five witnesses have been examined, I am of the opinion that if the directions are issued to the trial Court to expedite the trial, the purpose will be served. 1/2
914-BA-2321-24.DOC 4) In that view of the matter, at this stage, I am not inclined to grant of bail. Accordingly, the application is rejected and disposed of. 5) The trial Court is directed to expedite the trial and endeavour be made to conclude the same within six months.
6) Liberty is granted to the applicant to apply afresh before the trial Court if trial is not concluded within six months. 7) The learned Counsel for the applicant undertakes to place copy of this order on the record of the trial Court within two weeks from today. [ANIL S. KILOR, J.] 2/2
