Heard Ms. Khemka, learned Advocate for Applicant and Mr. Kulkarni, learned APP for State.

By order dated 17.02.2025 passed by this Court, Applicant was granted bail, however he has not been released from prison as he was unable to furnish bail bond as directed in paragraph No. 14(i) of the said order. Letter dated 24.02.2025 is sent by Applicant to this Court through the Superintendent of Jail, Thane Central Prison. In the letter, Applicant has stated that due to his extreme poverty, he is unable to furnish the surety as there is nobody to help him. He has therefore requested the Court to permit him to furnish provisional cash bail for his release and to furnish surety within a period of one month after his release from prison. Along with his letter, he has also appended copy of the decision of the Supreme Court dated 31.01.2023 in SMWP (Cri)

903. BA-2346-2024.docx No. 4/2021. Perusal of the said decision shows that Supreme Court has passed certain directions with respect to accused who are in jail and who have been granted bail but unable to furnish bail bond due to various reasons.

In view of the exigency expressed by the Applicant, following clause be added after clause 14(i) in the order dated 17.02.2025:- "(ii) Applicant is permitted to furnish provisional cash bail of Rs. 15,000/- for his release immediately and file undertaking that he will provide one or two sureties in the like amount of Rs. 15,000/- within a period of four weeks after his release from prison on bail which shall be accepted by the Court / Investigating Officer. The Applicant shall provide the sureties as directed;" 4.

Addition to the above effect be carried out in the order dated 17.02.2025 and modified order be uploaded again. Rest of the order shall remain as it is.
