2) By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No. 128 of 2018 registered with Nallasopara Police Station, for the offences punishable under Sections 302, 120(B), 201, r/w 34 of the Indian Penal Code, 1860.
3) The main accused has been released on bail by the Hon'ble Supreme Court of India on the ground of long period of incarceration. The applicant is also in jail from last six and half years. 1/3
4) Thus, considering the ground on which the co-accused Vishal Yadav was granted bail by the Hon'ble Supreme Court of India vide order dated 27th September, 2024 in S.L.P (criminal) No. 10325 of 2024, the applicant is entitled for parity. Accordingly, I pass the following order.
ORDER
i) The Bail Application is allowed;
ii) It is directed that the Applicant shall be released on bail in Crime No. 128 of 2018 registered with NallaSopara Police Station, Dist. Palghar, for the offences punishable under Sections 302, 120(B), 201, r/w 34 of the Indian Penal Code, 1860, on furnishing P.R. Bond of Rs.50,000/- (Rupees Fifty Thousand) with one solvent surety in the like amount;
iii) The applicant shall attend Nallasopara police station once in a month on every First Monday in between 11:00 a.m to 1:00 P.m for the period of 12 months from the date of his release.
iv) The applicant shall attend the Court on each and every date unless exempted.
v) The applicant shall not tamper with the prosecution evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case. vi) The applicant shall inform his latest place of residence and mobile contact number and/or change of residence or 2/3
mobile details, if any, from time to time to this Court and to the Investigating Officer of the concerned Police Station. Vii) The applicant shall surrender his passport if any, to the concerned police station and shall not leave India without prior permission of this Court viii) The prosecution will be at liberty to file an application for cancellation of bail, in case of breach of any of the above mentioned conditions by the accused.
ix) The applicant be informed about this order by e-mail through Superintendent.
Application stands disposed of, accordingly.
