By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.107 of 2023 registered with Paud Police Station, Pune Rural, for the offences punishable under Sections 302, 307, 394, 397, 341, 427, 504, 507, 34 of Indian Penal Code.

Having gone through the charge sheet and relevant material collected by the Investigating Officer during investigation it is evident that the offence is very serious and as far as complicity of the Applicant is concerned, the Applicant was identified by a witness. Furthermore, there are statements of eye witness who has seen the Applicant assaulting the deceased.

Thus, considering the nature of allegations and the material collected by the Investigating Officer during investigation, I am of

2 of 2 914.BA.2376.2024.doc the opinion that sine there is sufficient incriminating material available on record, this is not a fit case for grant of bail. Accordingly it is rejected.
