Heard learned Advocate for the Applicant.

As directed on the last date i.e. 6th August 2024, learned APP today, clarified that apart from the present offence, he is arrested in 3 offences. One at Kharghar, second at Rabale and third at Sanpada. There are in all 21 offences of theft but his involvement is disclosed in present offence and above referred 3 offences. 3.
Though, on merits, his Bail is already rejected on 8th March 2023, considering the period undergone in jail since 11th October 2021, bail can be granted.

The offences are under Sections 379, 427, 465, 466, 468, 471, 473, 474, 413, 419 120-B read with 34 of the Indian Penal Code, 1860. ("IPC"). However, he can be asked to furnish local surety. Hence, following order is passed:-
O R D E R
(i) Application is allowed.
(ii) Applicant - Manish Devsibhai Chovatiya arrested in connection with C.R.No.88 of 2021 registered with Sanpada Police Station - Navi Mumbai for the offences punishable under Sections 379, 427, 465, 466, 468, 471, 473, 474, 413, 419 120-B read with 34 of IPC, be released on bail on furnishing personal bond and surety bond of Rs.50,000/- (Rupees Fifteen Thousand Only).
(iii) Applicant is directed to furnish a surety from Thane district. (iv) He is further directed to attend the trial Court punctually. (v) Applicant not to threaten the prosecution witnesses or to allure them in any manner.
(vi) In case of breach of any of the conditions, the bail of the Applicant is liable to be cancelled after notice. 5.
Application is disposed of in the aforesaid terms. 6.
