By this application under Section 439 of the Code of Criminal Procedure, the Applicant is seeking bail in Crime No.81 of 2023, registered with Bhigwan Police Station, District: Pune (Rural) for the offences punishable under Sections 307, 324, 504, 506 of Indian Penal Code (for short 'IPC').

Having gone through the charge-sheet and relevant material collected by the Investigating Officer during the investigation, it is apparent that the offence is serious considering by SUNNY ANKUSHRAO THOTE Date:
2024.09.26 14:15:58 +0530 SUNNY ANKUSHRAO THOTE the injuries. The Applicant tried to kill his real brother after expressing his wish to the victim to allow him to sleep with his wife who is sister-in-law of the Applicant. There are four antecedents SUNNY THOTE
5-BA-2425-2024.doc against the Applicant including the offence under Section 302 of IPC. He was in custody for four years in the said offence under Section 302 of IPC and after coming out from the jail on bail, he committed the present offence.

Moreover, considering the statement of the mother of the Applicant and the reasons for which he has assaulted the victim coupled with antecedents, I am of the opinion that if the Applicant is released on bail, he would repeat the offence. 5.
Thus, considering the nature of evidence and allegations, I am of the opinion that this is not a fit case for grant of bail. 6.
Accordingly, the application is rejected.
