2) By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No. 498/2023 registered with Mandrup Police Station, Dist. Solapur, for the offences punishable under Section 363, 376, 376(2)(n), 376 (3) and 506 of the Indian Penal Code, 1860 and Sections 4, 6, 8, 12 and 42 of the Protection of Children from Sexual Offences Act, 2012. 3) Having gone through the charge-sheet and the relevant material collected by the IO during the investigation it is evident that applicant is married one. The victim is aged 12 years and 11 months. The applicant allegedly committed sexual assault on her. There is a statement of the victim and also medical evidence show the complicity of the applicant in the alleged offence.

902-BA-2505-2024.DOC 4) Considering the sufficient incriminating material available on record against the applicant in the alleged offence, I do not find this is a fit case for grant of bail.

5) Accordingly, the application is rejected.
