This is an Application under Section 439 of the Code of Criminal Procedure, 1973 seeking Regular Bail in connection with C.R.No.725 of 2020 registered with Charkop Police Station for the offences punishable under Sections 376 and 506 of the Indian Penal Code, 1860 (for short "IPC"); Sections 4, 8 and 12 of the Protection of Children from Sexual Offences Act, 2012 (for short "POCSO") and 67(B) of the Information Technology Act, 2000. 3.
Ms. Lakariya would submit that Applicant is incarcerated for the past 5 years. One of the principal submission is that when the
49.BA.2511.24.doc alleged offence took place the victim was 19 years old despite which POCSO has been applied.

Mr. Kulkarni, learned APP is directed to take cognizance of this order and instructions from the concerned Investigating Officer and apprise the Court on the next adjourned date. 5.
