Heard Ms. Shaikh, learned Advocate for Applicant and Ms. Bajoria, learned APP for Respondent No.1 - State. 2.

Considering the impleadment of Respondent No.2, Ms. Shaikh, learned Advocate for Applicant is directed to hand over a spare copy of the Application to the concerned Investigating Officer who is present in the Court through learned APP Ms. Bajoria. 3.

Ms. Shaikh would inform the Court that copy of the Application shall be handed over to him immediately within the next hour. Considering the long incarceration of the Applicant and the facts of the case argued by the learned Advocate on the previous occasion, I am inclined to take up this Application.

Concerned Investigating Officer is directed to depute a responsible lady police officer to serve a copy of the Application on Respondent No.2 and obtain the consent of Respondent No.2 as to whether she requires legal representation through Legal Aid and inform the same to the Court through learned APP on the next adjourned date. If this exercise is carried out, this Court shall pass further orders to appoint an Advocate / Counsel of this Court to espouse the cause of Respondent No.2 through the Legal Aid and take up the present Application for hearing.

Let the above exercise be completed by Saturday i.e. 15th February 2025.
